1. Scope and provider
These terms of use apply to the use of the Noah iOS app, offered by Mahmoud Ali Khan. Deviating terms only apply if we have expressly agreed to them.
2. Purpose of the app
Noah supports parents and legal guardians in documenting everyday observations about their child, viewing developments and recurring situations more clearly, and creating reports for recipients of their choosing.
Noah is not a medical device. Content, sorting, pattern indications, and reports do not constitute a diagnosis, treatment recommendation, or medical advice. Decisions about health or support measures should be made with appropriately qualified professionals. In the event of acute danger, contact emergency services.
3. Requirements and use
You may only use the app if you are authorized to process the information entered about the child. Do not enter unlawful content and do not infringe the rights of third parties. Share exported reports only with people who are meant to receive them.
You are responsible for checking entries and automatically structured content for accuracy. In particular, voice transcription and AI-assisted assignment can be incomplete or inaccurate.
4. Local storage and backup
App content is kept locally on your device. You are responsible for suitable device backup and for protecting your iPhone. If it is lost, defective, reset, or the app is deleted, data may be lost. Exported files are subject to the rules of the respective storage location or recipient.
5. Optional third-party features
Optional voice input uses external services for transcription and structuring. It is not required if you enter content manually. Noah transcribes and assigns the content you explicitly speak, but does not create a diagnosis, interpretation, summary, or pattern analysis. Details on providers, data types, and processing can be found in the privacy policy.
6. Noah Plus, trial period, and renewal
The app can be downloaded for free and used with manual entries, history, profile, highlights, and reports. The one-time voice input when setting up the profile also remains free. Noah Plus unlocks daily voice entry with automatic transcription and preselection of type and area.
Noah Plus is offered as a monthly or annually renewable subscription through Apple's App Store. Before purchase, the app shows the price and billing period applicable to your store. If a 14-day free trial period is shown to you and you are eligible, payment only begins after it ends.
The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current billing period in your Apple ID subscription settings. Apple charges the payment method on file within 24 hours before the start of the next period. Cancelling ends Noah Plus at the end of the period already paid for; locally stored content and all free features remain available. You can restore previous purchases in the app.
7. Availability and further development
We strive for reliable operation but do not owe uninterrupted or error-free availability at all times. Features may be adjusted, added to, or discontinued for objective reasons, such as security, technical development, or changed legal requirements. Statutory claims remain unaffected.
8. Rights to the app
Software, design, texts, and other content we provide are legally protected. You receive a simple, non-transferable right to use the app to the intended extent for private purposes. Mandatory statutory usage rights remain unaffected.
9. Liability
We are liable without limitation for intent and gross negligence, for culpable injury to life, body, or health, and under mandatory statutory provisions. For slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
10. Termination and final provisions
You can stop using the app at any time by deleting it. Deleting the app does not end an active App Store subscription; you manage and cancel this in your Apple ID subscription settings. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of the country of your habitual residence remain unaffected.
